Terms & Conditions


Acceptance of Terms
These terms and conditions ("Terms") govern all supply of goods and services ("products") by Blooms and Potions Ltd T/A Bouquet Floral Studio ("Bouquet Floral Studio", "Bouquet Floral", "we, "us") to you, the purchaser of products from us via our website at bouquetfloral.co.nz ("the website") or by phone. They are effective from 26.02.2025 and will replace all earlier Bouquet Floral Studio terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these Terms by notice to you. Notice may be given by posting the revised terms and conditions on our website.

If you are purchasing on behalf of another entity, such as a company, you confirm you are authorised to agree to these Terms on behalf of the entity.


Availability and Supply

Flowers
We make everything to order, using the freshest products available. Seasonal changes will affect flower availability. If a flower, foliage, packaging materials or container is unavailable, we'll substitute it with a similar item of equal or greater value. While we endeavour to replicate the image of your purchased item, please expect some variations in bouquets, arrangements, handmade goods, packaging and decoration due to the creative process.

Products
All orders are subject to availability. If a product is not available for any reason, we will endeavour to notify the non-availability on our website or contact you directly if an order has been placed.

Pricing
All prices on our website are in New Zealand Dollars and are inclusive of any Goods and Services Tax. All product prices are exclusive of delivery fees. All prices are correct when published. We reserve the right to alter prices at any time.

Ordering Gifts
To send a gift, select your desired items on the website, and click "ADD TO CART." Upon completion, proceed to "CHECKOUT." In the Recipient Delivery Address section, provide the recipient's details and delivery date. You may include a personal message to be sent with your order in the "Message (Optional)" box.

An Order Confirmation will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details and contact details of the delivery recipient are correct.

Delivery

Local Delivery
Our local delivery areas include Whakatane and surrounding areas, including Coastlands, Ohope, Kawerau, Te Teko, Matata, Edgecombe, Taneatua and Opotiki.

All orders within Whakatane, Coastlands and Ohope are delivered by our Bouquet Floral Van. If ordered before 1pm these will be delivered on the same day. As we deliver those orders ourselves they cannot be tracked.

Orders for other areas including Kawerau, Te Teko, Matata, Edgecombe, Taneatua and Opotiki must be ordered by 1pm from Monday to Thursday for next day rural delivery or courier.

Orders placed on our website on Saturdays and Sundays will be delivered on Mondays to Whakatane, Ohope or Coastlands. Outside these areas orders will be dropped at depots for delivery on Tuesday. We do not provide weekend deliveries unless by prior arrangement and only to Whakatane and surrounding areas. Orders placed on our website on Public Holidays will be delivered the next working day.

We will use all reasonable endeavours to ensure that orders are dispatched promptly according to our cut-off time of 1pm, unless you have requested an alternative delivery date during the checkout process.

Local Delivery Fees
All online orders will incur a delivery fee to cover the delivery cost. Additional orders to the same delivery address on the same delivery run will not incur an additional delivery fee. The cost of local delivery for orders is as follows:

New Zealand Wide and International Delivery
All orders outside our local delivery areas will be processed and delivered via Interflora. We are unable to accept Interflora orders via our website. Please call our shop on 07 308 7261 to place an Interflora order.

Direct Credit
We accept payment by Direct Credit to our bank account below. All direct credited funds must be cleared in our bank account before we can prepare and send your order.

Security

Credit Card Security
We do not retain your credit card number on our website. All payments are processed via Windcave's secure payments system to ensure high levels of payment security and are subject to Windcave's terms and conditions. Click here to view.

Refunds, Returns and Exchanges
Please choose carefully as we do not refund or exchange if you change your mind. If the products are faulty, we will meet our obligations under the Consumer Guarantees Act. You will not be charged any additional shipping or handling fees for replacement.

Flowers
Due to the perishable nature of our products, please follow our Flower Care instructions to extend the lifespan and enjoyment of your flowers. The recipient is responsible for adhering to these instructions.

If your flowers have been delivered in unsatisfactory condition, please notify us in writing by emailing bokay@xtra.co.nz within 24 hours of delivery. In your email please include a description of the unsatisfactory condition and attach images of the entire arrangement for us to review.

Other Products
We regret we are unable to refund, exchange items or accept returns of other products for reasons other than where they are damaged or faulty. All damaged or faulty items must be notified in writing to bokay@xtra.co.nz within 24 hours of delivery, including a fault description and product images for us to review.


Liability Limitation
Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Contracts and Commercial Law Act 2017 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.

To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.

Our maximum liability to you (if any) will be limited to the value of any faulty products supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.


Applicable law and jurisdiction
Unless we otherwise agree in writing, these Terms, and our Website Terms of Use contain all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.

Use of our website, supply of products by us to you and any other matter arising from these Terms are subject to the laws of New Zealand. The Courts of New Zealand will have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these Term, or with the use of website or supply of any products.


General Conditions
If we fail to enforce any terms or to exercise our rights under these Terms at any time, we have not waived those rights.

If any provision of these Terms is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these Terms.

Unless any provision in this agreement expressly provides otherwise, these Terms are not intended to confer a benefit on any person or class of person who is not a party to them. We may deliver notices to you by sending them to an email address that you have notified to us.
